RE/MAX International, Inc. is pleased to announce that, with the cooperation of certain brokers and the RE/MAX Dixie Region in Alabama, it has reached an agreement with the Attorney General's Office and the Real Estate Commission of the State of Alabama concerning the legality of charitable donations made by agents and brokers to the Children's Miracle Network (CMN). Concerns had been raised by the Alabama Real Estate Commission that agents who pledged and donated a portion of each real estate transaction to the CMN may be engaged in unlawful fee-splitting or sharing of a commission with an unlicensed person in violation of Alabama Code ? 34-27-36. After discussions with the Alabama Real Estate Commission and the Attorney General's Office, RE/MAX International, Inc. and a cooperating RE/MAX brokerage and agent, filed suit in the Circuit Court of Montgomery Alabama seeking a declaratory judgment to confirm that charitable donations made on a per-transaction basis to CMN from commissions earned are not fee splitting or sharing of commission with an unlicensed person as defined by the Alabama statute. The Attorney General's Office agreed with RE/MAX's analysis that the Alabama statute did not apply to charitable donations to CMN made by agents from earned commissions and we submitted a joint order to the court. On June 21, 2006, the Alabama court signed a judgment which officially recognized the legality of the practice of agents making charitable donations to the CMN on a per transaction basis under Alabama law.
